In order to promote indigenous inventive activity, the Corporation provides financial and technical assistance to the Indian inventors working in universities for patenting of inventions in India without any obligation of assignment of the patent to the Corporation. In case of Govt. Departments, R&D organization and R&D Institutes, NRDC shall provide technical assistance and facilitate the filing of Indian Patent application covering the subject matter of invention at nominal service charge of 25% over and above actual expenditure involved in securing patent in India. Filing of patent applications for inventions emanating from industries is considered to be a purely commercial activity for NRDC for which it will charge 25% as service charge over and above actual cost incurred. If any inventor wishes to avail this facility, he has to submit the application for financial assistance, for filing a patent application, along with the relevant technical information which helps the corporation to evaluate the proposal. The basic criteria for evaluation are novelty, Non-obviousness and Industrial Utility. These applications are evaluated by in-house technical experts for deciding about the grant of financial assistance. The invention may be referred confidentially, if necessary, to the outside experts working in government organizations, educational institutions or public organization to solicit expert's opinion. The patent office may also be consulted. The outcome of the application is communicated to the applicant in due course of time. If the application is approved, the inventor is requested to meet the patent attorney on the Corporation's panel for furnishing all the technical details of the invention so that an application along with the provisional/complete specification in filed with the appropriate Patent Office at the earliest. In case the provisional specification is filed in the beginning, complete specification is filed in due course within the stipulated time period but once the application is filed, the inventor gets priority from the date of filing. 75% of all the expenses from the date of grant of financial assistance to any inventor working in a university till grant of patent and its subsequent sealing are borne by NRDC. As soon as the patent application is accepted, the intimation is sent to the applicant and in due course of time, the letters patent document will be mailed to the inventor. The inventor is free to commercialize the invention after the sealing of the patent without obligation to NRDC. However the inventor may approach the Corporation for
assistance in commercializing /licensing products/processes. |
